Rhode Island Wetland Permitting & Delineations

Wetland Flagging

Navigating development in Rhode Island requires a precise understanding of environmental regulations. Whether you are planning a new home construction, a septic repair, an accessory dwelling unit (ADU) or a subdivision, identifying the wetlands on your property is the first critical step. At Avizinis Environmental Services, we specialize in guiding homeowners and developers through the complex permitting processes mandated by the Rhode Island Department of Environmental Management (RIDEM) and the Coastal Resources Management Council (CRMC).

Our process begins with professional wetland delineation, also referred to as flagging. We assess your site to locate all features regulated as Freshwater Wetlands and flag a line of demarcation based on the specific hydrology, soil indicators, and vegetation criteria required in Rhode Island. We also identify regulated Vegetated Buffer and Buffer Zones within the Jurisdictional Area (formerly known as perimeter wetlands and riverbank wetlands) that were updated under the new 2022 RIDEM Freshwater Wetland Rules. Our flagging is essential to determine your "buildable area" and avoid costly enforcement actions.

Once the resource areas are identified, our flags can be used by your preferred engineer or surveyor for planning purposes. We provide GPS data associated with our maps and a report of findings detailing the regulatory implications.

For work inside these jurisdictional areas, you may be required to apply for a permit before starting any projects.  Inland projects are subject to the RIDEM’s recently overhauled rules resulting in new permit types. These include the standard Freshwater Wetlands Permit, Application for a Significant Alteration, Request for Regulatory Applicability, Request to Determine the Presence of Jurisdictional Area, and Request to Verify Freshwater Wetland Edges. Let us help you take your project from submitted to approved.

For coastal properties, we navigate the CRMC Assent process, addressing specific challenges like coastal features, setbacks, and storm protections.

We assist clients in resolving enforcement cases through wetland restoration plans and retroactive permitting to bring properties back into compliance. Don’t let regulatory confusion stall your project—trust a local expert to secure the approvals you need. Avizinis Environmental is with you through the entire application process.
