WEtland Permitting & Delineations

Development in Massachusetts is governed by some of the strictest environmental laws in the country, specifically the Massachusetts Wetlands Protection Act (WPA) and local town bylaws. Whether you are proposing a new subdivision, a single-family home, or Accessory Dwelling Unit (ADU), success starts with understanding your obligations to the local Conservation Commission. At Avizinis Environmental Services, we provide expert guidance through the complex municipal and state permitting process.

The foundation of any project is an accurate wetland delineation. Our team identifies and flags Bordering Vegetated Wetlands (BVW) and other wetland features based on the specific hydrology, soil indicators, and vegetation criteria required by MassDEP.  Your preferred surveyor or engineer can then record our flags or import our GPS data for use in the planning process.   In our report of findings, we include information on critical jurisdictional areas such as the designated Buffer Zone, Riverfront Areas, Isolated Land Subject to Flooding, and a historical aerial review.  Mapping these resources early is the only way to establish a realistic "limit of work" and avoid problems later.

We handle all phases of the filing process; from smaller projects with minimal impact, to significant construction which requires a more comprehensive narrative.  Your local Conservation Commission may require you to file a Request for Determination of Applicability (RDA), Abbreviated Notice of Resource Area Delineation (ANRAD), or Notice of Intent (NOI).  We represent your interests at public hearings to secure an Order of Conditions (OOC) that allows you to build.

If you are dealing with an Enforcement Order or a "Cease and Desist" from a town agent, we can help. We specialize in negotiating with Conservation Agents and designing wetland replication and restoration plans to resolve violations efficiently. From engagement to the final Certificate of Compliance, we ensure your project meets all regulatory standards.
